Terms of Use

Please read these Terms of Service ("Terms") carefully before using FundClaro.com (the "Platform") operated by FundClaro ("we", "us", or "our"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. About the Service

FundClaro is a market sentiment analysis platform that aggregates publicly available news and market data to generate sentiment signals based on fundamental factors. The Platform is intended as an informational and analytical tool only.

IMPORTANT: FundClaro does NOT provide financial advice, investment advice, trading recommendations, or any form of regulated financial services. All sentiment signals and analyses are provided for informational purposes only and should not be construed as a recommendation to buy, sell, or hold any financial instrument.

2. Eligibility

By using FundClaro, you represent and warrant that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You are not prohibited from using the Platform under applicable laws in your jurisdiction.
  • If using on behalf of a company, you have authority to bind that company to these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and not share it with third parties.
  • Notify us immediately at [email protected] of any unauthorized use of your account.

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Billing: Paid features are billed via Stripe on a recurring basis according to your selected plan.

4.2 Free Trials: Free trials, if offered, automatically convert to paid unless canceled before trial end.

4.3 Cancellation: Cancellation is available via account settings and takes effect at the end of the current billing period. No partial-period refunds except where required by law.

4.4 Price Changes: Subscription prices may change with 30 days' prior notice. Continued use after change means acceptance.

5. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any regulations.
  • Reproduce, redistribute, sell, or resell platform content or data without written consent.
  • Use bots, scrapers, or crawlers to access or extract data.
  • Reverse-engineer, decompile, or disassemble any part of the Platform.
  • Interfere with Platform integrity, performance, or servers.
  • Upload viruses, malware, or malicious code.
  • Attempt unauthorized access to any portion of the Platform or related systems.
  • Use the Platform to manipulate markets or engage in market abuse.

6. Intellectual Property

All content, features, and functionality of the Platform, including software, text, graphics, logos, and data compilations, are owned by FundClaro or its licensors and protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal or internal business purposes in accordance with these Terms.

7. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted service, complete accuracy, defect correction, or absence of harmful components. SENTIMENT SIGNALS ARE NOT FINANCIAL ADVICE. Any investment or trading decisions are at your own risk.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FundClaro AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR FINANCIAL LOSSES ARISING FROM USE OF OR INABILITY TO USE THE PLATFORM.

IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO FundClaro IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €100.

9. Indemnification

You agree to indemnify, defend, and hold harmless FundClaro and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Platform, your violation of these Terms, or your violation of third-party rights.

10. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate with third-party services (including Stripe). We do not control and are not responsible for third-party content, policies, or practices.

11. Termination

We may suspend or terminate access to the Platform at any time, with or without cause or notice, including for violations of these Terms. Provisions that should survive termination remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Czech Republic. Disputes are subject to the exclusive jurisdiction of courts in the Czech Republic.

EU consumers may also use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

13. Changes to These Terms

We may modify these Terms at any time and will notify material changes at least 14 days in advance by email or in-platform notice. Continued use after the effective date constitutes acceptance.
